Terms of service.

Plain-language scope of how engagements with Whitelam Media work. Last updated 19 May 2026.

Who we are

Whitelam Media is a modern web agency operating from Madrid, Spain, run by Paul Whitelam. We design, build, host and support websites and operational systems for clients across the US, UK and EU. The work we deliver

Engagements fall into the three published tiers: Foundation Level, Growth Platform and Authority System. The Foundation Level and Growth Platform tiers ship a defined scope at a fixed price. The Authority System tier is bespoke; the brief and final price are agreed in writing before the deposit is taken. Bundled monthly support (Foundation Support, Growth Support, Authority Support) ships with every tier.

The scope of any specific engagement is set out in the proposal you receive at https://whitelam.media/proposals or in a written brief exchanged before payment. The proposal is the operative definition of scope for that project.

Payment

  • 50% deposit is due to start the build. 50% balance is due on launch.
  • The launch payment is only due once the site is live on your domain and you're satisfied with how it's running.
  • Bundled monthly support is billed in advance, monthly, on the date your build goes live.
  • Payments are taken through Stripe on the whitelam.media domain via Stripe Payment Element. Card details never touch our servers.
  • All prices are quoted in US dollars unless otherwise stated. Stripe converts to your card's currency at point of payment.

Refunds

Deposits are refundable until work begins. Once we've started, the deposit covers design and discovery work already delivered; refunds at that point are at our discretion based on what's been shipped. The launch payment is contingent on you signing off the build, so there's nothing to refund if you don't sign off.

Monthly support is cancellable at any time with one month's notice. We don't refund partial months but we don't bill new months after cancellation either.

Intellectual property

On full payment, you own the finished website and all custom code, content, design and brand assets we produced for you. Third-party components (open-source libraries, fonts, plugins, stock imagery licensed for your project) are governed by their own licences and ownership stays with their respective licensors.

We retain the right to reference the work publicly in our portfolio, case studies and marketing materials unless you ask in writing for the engagement to be kept private.

Hosting and ongoing support

While on a Whitelam Media monthly support plan, we host the site on premium edge infrastructure (Vercel and partners), keep SSL valid, run uptime monitoring, ship security patches and handle the changes your support tier covers. If you choose to leave at any point, we hand over the full source code in a private GitHub or Git repository owned by you, plus a documented runbook for re-hosting. No lock-in. No exit fee.

Confidentiality

We treat your business information, strategy documents, financial data, customer lists and unreleased product details as confidential. We share only what's needed to deliver the work, and only with team members or contractors bound by the same confidentiality. We do not sell, share or use client data for any purpose other than delivering the work you've commissioned.

Liability

We deliver the work to a defined standard (set out in our public Standard at https://whitelam.media/about and the internal SITE-STANDARD spec). If we breach this standard and the work is materially impaired, we'll fix it at no cost or refund the affected portion. Beyond that, our liability is capped at the total amount paid to us under the relevant engagement in the preceding 12 months. We're not liable for indirect losses (lost profits, lost data, business interruption) except where required by applicable law.

Governing law

These terms are governed by the laws of Spain. Any dispute that cannot be resolved by good-faith conversation will be submitted to the courts of Madrid, Spain. Nothing in this clause limits any statutory consumer rights you may have under the laws of your own country.

Changes to these terms

We may update these terms from time to time. The version that applies to your engagement is the one in force on the date you accept the proposal or the deposit clears, whichever is earlier. We'll flag material changes by email if you have an active support plan.
